Terms of Use

The terms of use that govern your use of Formidium websites and applications.

Please review the Terms of Use ("TOU") carefully. If you continue to browse, access, download or use any of our websites or applications (including but not limited to mobile, desktop, and web-based applications) (collectively referred to as the "Suite"), you are agreeing to comply with and be bound by the following Terms of Use, which together with our privacy policy govern our relationship with you in relation to the Suite. If you disagree with any part of these Terms of Use, please do not use our Suite.

We reserve the right to update and modify the TOU at any time without notice to you. When we make updates to the TOU, we will update the effective date of the TOU. We will also notify you of changes via notification on our applications. By using our Suite after a new version of the TOU has been posted, you agree to the terms of such new version.

The term “our” “us” or “we” refer to the owner of the Suite. The terms “you” or “your” refer to the user or viewer of our Suite.

The use of our Suite is subject to the following terms of use:

  • The content, features and functionality of the Suite are for your general information and use only. They are subject to change without notice.
  • The Suite uses cookies to monitor browsing preferences. Our applications may use tracking technologies such as device identifiers, SDKs, or analytics tools to monitor usage patterns and enhance user experience.
  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered through the Suite for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by applicable law.
  • The Suite contains material which is owned by or licensed to us. This material includes, but is not limited to, text, logos, icons, images, sounds, music, digital downloads, data compilations, software, documents, design, layout, look, appearance and graphics. This material is the exclusive property of us or our content suppliers and is protected by applicable intellectual property laws. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. All rights not expressly granted to you in this TOU are reserved and retained by us or our licensors, suppliers, publishers, rightsholders, or other content providers.
  • All trademarks reproduced on the Suite, that are not the property of, or licensed to, the operator are acknowledged on the Suite.
  • As a condition of your use of the Suite, you will not use the Suite for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Suite in any manner that could damage, disable, overburden, or impair any of our servers, or the networks connected to any of our servers, or interfere with any other party's use and enjoyment of any part of the Suite.
  • You may not attempt to gain unauthorized access to any part of the Suite, other accounts, computer systems, or networks connected to any of our servers, through hacking, password mining, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Suite. You may not attempt to copy or change, alter or otherwise attempt to modify the Suite or these TOU. Unauthorized use of the Suite may give rise to a claim for damages and/or be a criminal offense.
  • From time to time, the Suite may also include links to other websites which enable you to leave our Suite. The external sites are not under our control and we are not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. These links are provided for your convenience to provide further information, and the inclusion of any link does not imply endorsement by us of such site.
  • You may be required to create an account to access certain features of the Suite. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. You agree to provide accurate and complete information when registering or using the Suite and to update such information as necessary. You must immediately notify us of any unauthorized use of your account or any other breach of security.
  • Your use of our applications is also subject to the terms and conditions of the app store from which you download the application (such as the Apple App Store or Google Play Store). You agree to comply with such third-party terms in addition to these TOU.
  • It is your responsibility to ensure that you download the correct application for your device. We are not liable if you do not have a compatible device or if you download the wrong version of the application for your device. We reserve the right to terminate the service, and the use of the application, should you be using the service or application with an incompatible or unauthorized device. Your use of the Suite and any dispute arising out of such use of the Suite is subject to the applicable laws of USA and India.
